These Terms & Conditions (“Terms”) govern your use of WhiskedTea.com (the “Site”) and any purchase made through the Site. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. About WhiskedTea

WhiskedTea (“we,” “us,” or “our”) offers matcha-focused recipe books, tea products, and related content. Product descriptions, images, and pricing on the Site are subject to change without notice.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By using the Site, you represent that the information you provide is accurate and that you are authorized to use your chosen payment method.

3. Products & Orders

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order, including orders that appear fraudulent, contain errors in pricing or product information, or cannot be fulfilled. If your order is canceled after payment, we will issue a refund to your original payment method.

Physical books and certain products may be fulfilled by our publishing or fulfillment partners. Partner fulfillment does not change your rights under these Terms or our Refund Policy.

4. Pricing & Payment

Prices are shown in U.S. dollars unless otherwise stated and do not include applicable taxes or shipping unless noted at checkout. You agree to pay all charges associated with your order, including taxes and shipping fees displayed before you submit payment.

Payments are processed securely through our payment providers (such as Stripe or PayPal). We do not store full payment card numbers on our servers.

5. Shipping & Delivery

Shipping options, costs, and estimated delivery windows are shown at checkout. Delivery times are estimates only and are not guaranteed. Risk of loss passes to you upon delivery to the carrier, except where prohibited by law.

You are responsible for providing a complete and accurate shipping address. We are not liable for delays or failed delivery caused by incorrect address information or circumstances outside our reasonable control.

6. Returns & Refunds

Our Refund Policy explains when refunds, replacements, or cancellations are available. Because many of our products are food, beverage, or sealed goods, opened or used items generally cannot be returned. Please review the Refund Policy before placing an order.

7. Intellectual Property

All content on the Site—including text, photography, recipes, logos, graphics, and design—is owned by WhiskedTea or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission.

Purchasing a physical book or product grants you a personal, non-transferable license to use that product for personal use. It does not grant rights to republish recipes, images, or other materials from our books or Site.

8. Acceptable Use

You agree not to misuse the Site. Prohibited conduct includes attempting to gain unauthorized access to our systems, interfering with Site operation, scraping content for commercial use, submitting false information, or using the Site for any unlawful purpose.

9. Mail Club & Marketing

If you join our mail club, newsletter, or waitlist, you consent to receive emails related to your subscription. You may unsubscribe at any time using the link in our emails. We do not sell your personal information to third parties for their marketing.

10. Disclaimer of Warranties

The Site and products are provided “as is” and “as available” to the fullest extent permitted by law. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

Food and beverage products are for general consumption. Consult a healthcare professional if you have allergies, dietary restrictions, or health concerns related to caffeine or tea products.

11. Limitation of Liability

To the maximum extent permitted by law, WhiskedTea and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any product purchased through the Site. Our total liability for any claim related to an order will not exceed the amount you paid for that order.

12. Indemnification

You agree to indemnify and hold harmless WhiskedTea from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site.

13. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” at the top of this page will reflect the latest revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be brought in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.
